2. General Rules

   • The General Terms and Conditions (hereinafter GTC) regulate the use of accommodation and services operated by the Service Provider (Ambient Vendégház és Kávéház, Keszthely).
   • This GTC does not exclude the conclusion of special or individual agreements with travel agencies, intermediaries, tour operators, or others who cooperate with the Service Provider in selling services over the long term.

3. The Contracting Party

   • The contracting party is any natural person, legal entity, or organization without legal personality who orders and uses the services of the Service Provider (hereinafter collectively: Guest).
   • If the Guest directly orders services from the Service Provider, they become the Contracting Party. The Service Provider and Guest collectively become the contracting parties.
   • If a third party (hereinafter referred to as Intermediary) orders services on behalf of the Guest, the conditions of cooperation are regulated by the agreement between the Service Provider and the Intermediary. In this case, the Service Provider is not required to verify whether the third party legally represents the Guest.

4. Formation of Service Agreement, Booking Process, and Modifications

   • Upon the Guest’s verbal or written request, the Service Provider will send a written offer. If no specific order is received within 48 hours, the Service Provider’s offer expires.
   • The agreement is only formed upon the Guest’s written booking and the Service Provider’s written confirmation. This confirmation must be in writing, at least via email.
   • Verbal bookings, agreements, modifications, or verbal confirmations are not considered contracts.
   • The service agreement for accommodation covers the period from payment of the deposit until the end of the booking duration.
   • Modifications or supplements to the contract require a signed written agreement by both parties.

5. Cancellation Policy

   • Guests may cancel their reservation free of charge if they notify the accommodation in writing 30 days before the arrival date. For cancellations between 29 and 14 days before arrival, a cancellation fee of 50% of the booking value applies. Cancellations within 13 days of arrival are subject to a 100% cancellation fee.
   • The Service Provider reserves the right to set different conditions in special cases (e.g., promotional offers, group travel, or events).

6. Prices

   • Current prices are posted on the www.secret-garden.hu website.
   • The Service Provider may change its prices without prior notice.
   • Once a booking is confirmed in writing, the Service Provider may not alter the confirmed price.

7. Payment and Guarantees

   • The total amount for the stay is indicated in the written confirmation sent by the Service Provider to the Guest.
   • Payment options include bank transfer, online payment, or cash upon arrival.

8. Check-in and Check-out

   • Rooms can be occupied from 3:00 PM to 6:00 PM on the day of arrival. Early check-in and late check-out may be available for an additional fee, depending on the accommodation’s capacity.

   • If the Guest does not arrive by 8:00 PM on the arrival date specified in the Contract, the Service Provider has the right to withdraw from the contract, unless a later arrival time has been agreed upon.

   • If the Guest has paid a deposit, the room(s) will be reserved until 12:00 PM the following day.

   • On the day of departure, rooms must be vacated by 10:30 AM. If the Guest does not vacate the room by 11:30 AM on the departure date indicated at check-in, and has not obtained prior approval from the Service Provider for an extended stay, the Service Provider is entitled to charge an additional day’s room rate, and the Service Provider’s obligation to provide services will cease simultaneously.

9. Service Usage Conditions

   • Guests must pay for their stay in full before occupying the room and verify their identity per legal requirements.
   • The accommodation may be used only by registered guests, and no unregistered persons may stay without prior notification.

10. Service Provider’s Liability

• The Service Provider is responsible for damages caused to Guests within the accommodation due to its or its employees’ fault.
• The Service Provider is not liable for events beyond its control (force majeure) or for damages caused by the Guest or persons under the Guest’s supervision.

11. Guest Rights

• Guests are entitled to use the ordered room and the facilities of the accommodation that fall within the usual scope of services.

12. Guest Obligations

• Guests must pay for the services ordered and comply with the house rules.

13. Confidentiality

• The Service Provider is obliged to handle personal data and other information in compliance with applicable data protection laws.

14. Force Majeure

• Circumstances beyond the control of both the Service Provider and the Guest (e.g., war, fire, flood) exempt both parties from fulfilling contractual obligations for the duration of such events.

15. Applicable Law and Jurisdiction

• The legal relationship between the contracting parties is governed by the Hungarian Civil Code.
• Disputes are subject to the exclusive jurisdiction of the Keszthely District Court or, if necessary, the Zalaegerszeg District Court.

16. Pets

• Due to the design of the buildings, pets are not allowed.

By booking the accommodation, the Guest declares and expressly acknowledges that they have read, understood, and carefully considered the provisions of the individual contract and these General Terms and Conditions (GTC), as well as their consequences. Furthermore, the Guest accepts these provisions as binding upon themselves, their companions, and any persons under their supervision.
